Title Deed, DASK, Settlement: What You Need to Know During the Purchase Process

When buying a property, it is not only the price or location that should be taken into consideration. Legal and technical processes such as title deed, DASK and occupancy directly affect both the legal status and future security of the property you are considering purchasing. In this article, we will discuss these three important concepts that you may encounter when purchasing a property in detail.

1. What is Title Deed and Why is it Important?

Title deed is the official document showing who owns a property. In Türkiye, all properties are registered by the General Directorate of Land Registry and Cadastre, and purchase and sale transactions take place here.

Title Deed Types:

Condominium Title Deed: Indicates that all legal processes of the independent section (e.g. an apartment) have been completed.

Floor Allotment Deed: It is issued for buildings that are under construction or for which no occupancy permit has been obtained.

Land Title Deed: It is the title deed given for land that has no structures on it.

Why is it important? The type of title deed indicates the legal status of the building you are purchasing and the stage it is in. A flat that is not a condominium may be considered "incomplete" legally, which could lead to problems in the future.

2. What is DASK (Compulsory Earthquake Insurance)?

DASK, or Compulsory Earthquake Insurance, is a legal insurance that must be taken out against earthquakes and earthquake-related damage. In countries located in earthquake zones like Türkiye, this insurance is of great importance for both individual and social security.

Scope of DASK:

The foundation of the building,

The main walls,

Common walls separating independent sections,

Ceilings and floors,

Stairs,

Elevators and corridors,

Roofs and chimneys,

Complementary elements of the structure.

Why Mandatory?

Without DASK:

Title deed transfer cannot be made,

Water and electricity subscription transactions cannot be carried out,

Housing loans cannot be obtained from banks.

Therefore, be sure to check whether the DASK policy is up to date before purchasing a property.

3. What is Occupancy Permit (Building Occupancy Permit)?

A certificate of occupancy is a document showing that a building has been built in accordance with a permit issued by the municipality and is suitable for living in. It is not possible to legally move into a building without a certificate of occupancy.

What Happens If Occupancy Permit Is Not Obtained?

There may be problems with subscriptions such as electricity, water, natural gas,

It becomes difficult to use housing loans,

You may face criminal sanctions from the municipality,

In the future, significant costs may be required to obtain a occupancy permit.

We can also think of it as a Residence Permit = Legal Life Permit.

Provisional Acceptance vs. Final Acceptance:

Provisional Acceptance: Refers to the preliminary inspection carried out at the end of construction.

Final Acceptance (Iskan): Means that all checks have been passed and life can begin legally.

Things to Consider During the Purchasing Process

Check the title deed type. If there is no condominium, find out why.

Examine the DASK policy. Make sure it is current and up to date.

Request the occupancy certificate. Especially in second-hand housing, do not make any transactions without seeing the document.

Get an expert report. It confirms information such as title deed value, m2, floor plan.

Make inquiries from the municipality and the land registry office. Does the property have any debt, what is its zoning status, etc.
